O-1 Visa

The O-1 visa is for the foreign nationals who possess extraordinary ability in the sciences, arts, education, business, or athletics, or who have a demonstrated record of extraordinary achievement in the motion picture or television industry and have been recognized nationally or internationally for those achievements.

It includes 2 subcategories:

O-1A: individuals with an extraordinary ability in the sciences, education, business, or athletics (not including the arts, motion pictures or television industry)

O-1B: individuals with an extraordinary ability in the arts or extraordinary achievement in motion picture or television industry. “Extraordinary ability” means that these individuals have shown, through evidence such as receipt of nationally or internationally recognized prizes or awards for excellence in the field of endeavor, scholarly publications, original scientific, scholarly, or business-related contributions of major significance in the field, media coverage about their work or proof of high salary, that they are at the top of their respective field.

You need to have the job offer from the U.S. employer who will file the application on your behalf. The O-1 visa is granted for an initial period of up to three years with options
to extend status in increments of one year. The USCIS grants O-1 visas for time periods determined by the nature of the foreign national’s work in the United States.

As the standard of granting O-1 category by the USCIS is very high, it is important to consult the experienced immigration attorney to evaluate your credentials and achievements. Please do not hesitate to contact us to discuss your options.
